WILL & INHERITANCE

This page is a translation. The Japanese version is authoritative; if the two differ, the Japanese text prevails.

We help you draft a will and prepare an estate division agreement.

You may be in one of these situations

  • I want to leave a will so that my family does not fall out
  • We have reached an agreement, but I do not know how to put it in writing
  • Gathering the family registers to identify the heirs is hard work

Help with drafting a will

A will is an effective way of making sure your intentions are carried out. However, a defect in its form can render it invalid. We listen to your wishes and help you draft wording that meets the legal requirements.

If you are considering a notarial will, we also handle the correspondence with the notary office and the preparation of the required documents.

Preparing an estate division agreement

Once the heirs have reached an agreement, it is recorded in a document called an estate division agreement. It is an important document, needed to change the registered owner of real estate and to close bank accounts.

We take on everything from gathering the family registers needed to identify the heirs through to preparing the agreement.

What we can and cannot take on

We can take this on

  • Drafting the wording of a will
  • Support with the notarial will procedure
  • Gathering the family registers needed to identify the heirs
  • Preparing an estate division agreement

We cannot take this on

  • Negotiation or mediation where the heirs are in dispute (this is the work of an attorney)
  • The inheritance registration of real estate itself (this is the work of a judicial scrivener)
  • Inheritance tax returns (these are the work of a tax accountant)

Where a dispute has already arisen among the heirs, a Gyoseishoshi cannot assist. Please consult us where an agreement has been reached, or is likely to be reached.
